HDB MOP Exceptions When You Can Sell Before 5 Years

The 5-year MOP is the rule. But life doesnt always follow rules. Here are the situations where HDB may let you sell early.

All exceptions are at HDBs discretion. There is no guaranteed right to sell before MOP.

1. Divorce or Annulment

This is the most common MOP exception. When a marriage breaks down, the court may order the flat to be sold and proceeds divided. HDB generally allows the sale if the court order requires it.

What you need: Final Judgement (divorce certificate) and the Court Order for flat disposal

Options: Sell on open market, or one party takes over the flat (with HDB approval)

Restrictions: The party who takes over must still form a valid family nucleus. If neither party qualifies alone, the flat must be sold

CPF: Both parties must refund their CPF used + accrued interest from sale proceeds

2. Death of an Owner

If a co-owner passes away, the surviving owner(s) can apply to retain or sell the flat. The key question is whether the remaining household still forms a valid family nucleus under HDB rules.

If you genuinely cannot afford to keep the flat job loss, medical emergency, bankruptcy HDB may consider an early sale. This is not easy to get. HDB expects you to have explored all other options first: restructuring your loan, seeking HDB financial assistance, or renting out bedrooms.

Documents needed: Income statements, bank statements, evidence of debt, medical bills (if applicable), proof of job loss

HDB expects: That you have tried HDB financial assistance schemes first (e.g., mortgage restructuring, HDB deferment)

If approved: You can sell on the open market. CPF refund still applies from sale proceeds

4. Overseas Posting

If your employer posts you overseas for an extended period (typically 23+ years), you may apply to sell the flat before MOP. This applies to both government and private sector postings.

Documents needed: Official posting letter from employer, stating duration and location

Short postings: If the posting is under 2 years, HDB may suggest renting out bedrooms instead

Alternative: You may be able to rent out the whole flat with HDB approval if the posting is temporary and you intend to return

5. Compassionate Grounds

This is the catch-all category for situations that dont fit the above. Examples include severe medical conditions requiring relocation, family safety concerns (e.g., domestic situations), or other extraordinary circumstances. HDB evaluates these on a case-by-case basis and approval is rare.

Submit your request via the HDB Branch (in person), by mail, or through the myHDBPage portal online. Clearly state what youre asking for (sell, transfer, or retain).

Wait for HDBs review

Processing typically takes 48 weeks. HDB may request additional documents or an interview. Be prepared to follow up.

If approved, proceed with sale

Once HDB gives the green light, you can list the flat on the open market. The standard resale process applies from here OTP, valuation, completion.

Things to Keep in Mind

  • CPF refund still applies. Even if you sell early, all CPF used + 2.5% accrued interest must go back to your CPF OA. No exceptions.
  • Grants must be returned. If you received CPF housing grants and sell before MOP, the grant amount + accrued interest is refunded to CPF.
  • No guarantee of approval. HDB can decline your request. Having documents ready and a clear case helps.
  • Deferred income assessment. If you bought with a higher income ceiling concession, selling early may have additional conditions.
